Terms and Conditions for Classbook.lk

IMPORTANT: By accessing or using Classbook.lk ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Platform.
1. Definitions
- "Platform" refers to the Classbook.lk website and all associated services.
- "User" means any individual or entity accessing or using the Platform.
- "Content" includes all text, images, videos, documents, and other materials available on the Platform.
- "Services" refers to all educational tools, features, and functionalities provided by the Platform.
2. Account Registration and Security
- Users must provide accurate and complete registration information.
- Users are responsible for maintaining the confidentiality of their account credentials.
- Users must immediately notify us of any unauthorized use of their account.
- We reserve the right to suspend or terminate accounts that violate these terms.
3. Acceptable Use
Users agree not to:
- Use the Platform for any illegal purpose or in violation of any laws
- Post or share harmful, abusive, defamatory, or inappropriate content
- Attempt to gain unauthorized access to other users' accounts or the Platform's systems
- Use automated systems (bots, scrapers, etc.) to access the Platform without permission
- Interfere with or disrupt the Platform's operation or other users' experience
- Impersonate any person or entity or misrepresent affiliations
4. Intellectual Property
- All Platform content, excluding user-generated content, is owned by Classbook.lk and protected by intellectual property laws.
- Users retain ownership of content they create and upload but grant Classbook.lk a worldwide, non-exclusive license to use, display, and distribute such content for educational purposes.
- Unauthorized copying, distribution, or modification of Platform content is prohibited.
5. User-Generated Content
- Users are solely responsible for content they post or share on the Platform.
- We reserve the right to remove any content that violates these terms without notice.
- By posting content, users represent they have all necessary rights to share that content.
6. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT AVAILABLE THROUGH THE PLATFORM.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASSBOOK.LK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
- ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
- ANY BUGS, VIRUSES, OR MALICIOUS CODE THAT MAY BE TRANSMITTED THROUGH THE PLATFORM
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX MONTHS, OR ONE HUNDRED US DOLLARS (USD 100), WHICHEVER IS GREATER.
8. Indemnification
You agree to defend, indemnify, and hold harmless Classbook.lk, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with:
- Your access to or use of the Platform
- Your violation of these Terms
- Your violation of any third-party right, including intellectual property or privacy rights
- Any content you post or share on the Platform
9. Termination
- We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.
- Upon termination, your right to use the Platform will immediately cease.
- All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of Sri Lanka.
- Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in Colombo, Sri Lanka, in accordance with the Arbitration Act of Sri Lanka.
- Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Platform or via email. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
12. Miscellaneous
- These Terms constitute the entire agreement between you and Classbook.lk regarding the Platform.
- If any provision of these Terms is held invalid or unenforceable, that provision will be construed to reflect the parties' original intent, and the remaining provisions will remain in full force and effect.
- Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
